Can You Be Refused On A Point Thats Not In The Refusal Lette

At my hearing Home Office Rep bought up finance
In my refusal ECO had written 'N/A' for financial requirements as it had been met
Home office rep thought i was lacking in wages and i only showed 6 months of property income.
Judge told her to look again as i exceed the requirement.
She apologized and then said but i had not submitted a letter from my employer confirming job, pay etc. Which in the appendix fm says should be done. And i had orally admitted that i had not submitted it.
Judge said to her the ECO and ECM was satisfied and they didn't raise it so why is she?
She put it to the judge as her submission
Can the judge refuse me on a point raised in a hearing that was never in the refusal?

It's up to the JUDGE if he/she will accept..Most judges will refuse the ground if ECM did not refuse you on that ground..Hope and pray!!! Good luck
