Appeal rejected. Leave within 28 days.

Hi guys,

I have applied for Tier 1 Entrepreneur visas like 1.5 years ago and it was rejected so I appealed against it. Now that appeal has been rejected as well. It states that I have to do a re-appeal within 5 days or leave UK. I'm unable to leave within 5 days but is willing to leave before 28 days. How will that (leaving before 28 days) affect my future travels.

* Will my visa be banned ?
* Will my visa be overstayed ?
* Will I be able to put in a new application from outside UK ?
* Will this affect if I plan to visit somewhere other than UK in future ?

To re-iterate, I plan to leave UK with a future plan to come back after applying a new application from outside UK. But I'm unable to leave within next 5 days. But can leave before 28 days are up. Will this affect my future plans in a bad way?

@ hdsenevi, I will advice that you send application to FTT for permission to appeal to UT and that process will take another 6-8wks or even more and you can then plan your journey if you have made up your mind to leave the UK.

Do not ignore the appeal and expect to leave the UK within 28days as that might affect your future visa application.

Can I make the appeal and while it's being processed, can I withdraw my documentation and application/appeal and go back home. Will that affect my future travels plans?

Also, I've read of stories of UKBA not returning the documents and visa on time (within 20 days after requesting them). Is that still the case.

I mean, in short, will I be able to do an appeal, withdraw it and ask for the documents from UKBA so that I can go back home? I don't want to waste more time in UK in a state of uncertainty on my visa, as I plan to come back to UK within a short amount of time.

@ hdsenevi, you should submit your letter for permission to appeal to UT and while that is on-going, you should send a letter to Home Office requesting that you intend to travel to your country and need your passport, but don't withdraw your appeal yet.

Once you receive your documents from HO and then travel outside the UK, your appeal will be automatically considered as abandoned and in such case you will be fine applying again from your home country.
