indefinite leave to remain decision variation of leave

My husband and I have just received a letter telling us we have failed to get indefinite leave to remain as we could not provide a letter from the college he took his ESOL test. We married in Sierra Leone in December 2010 and He took the test in The Gambia and re-entered the UK in August 2011 after being messed around for eight months. We have sent all other information, both work and have never been in trouble with the law. because we cannot get information on weather the college used the right learner pack even though the certificate was passed and deemed as valid for him to return to the UK. They are questioning it even though it is awarded by City and Guilds.

they said he can stay till March 2016 but what are we supposed to do after that go to Sierra Leone

would appreciate any help Thanks

It sounds like they've extended his leave until March 2016 as a spouse.

That means you can reapply for ILR once you qualify

So your options are:
1) Take another test - get the right certificates - reapply
2) Pester the college - deal with the update - reapply
3) Appeal - see if a judge will have sympathy.

he has a valid certificate we sent the email we got from City and Guilds as they do not provide letters to confirm materials used for the test taken in the Gambia. My husband entered UK after providing his ESOL certificate and they had no problem with it, I cannot understand why they are questioning if the materials the college used was right when they accepted it for his Visa.

We are know going through so mush stress again as we have paid all that money for Indefinite Leave and they said no but extended it so that we cannot appeal the decision. in another two years we will have to pay again if we can afford it and probably get the same result.

is this a way they try to test if our marriage is genuine, there are people who are really in Love and we are! they are so unfair.
