ILR,PBS dependent and new born baby

Post by Sanju5000 » Sat Apr 12, 2014 11:33 am

Hi,

Hope someone can guide me with correct advice. I’m bit confuse at the moment after finding out new rules and reading different scenarios posted in the forum.
I’m currently in Tier 1 general visa and eligible for ILR in Jan 2015 and my husband in PBS dependent ( applied after July 12)

My question are
1) I’m expecting to go maternity leave from start of September this year. Therefore when I need to show my earnings can I take the 12 month before maternity leave? Therefore July13 to Aug14

2) As I’m planning to travel immediately after getting ILR can my baby include as a dependent in my ILR form without applying for British passport?

3) As my husband is not eligible to apply ILR since he is not qualify his 5 years in UK yet what is the best option he has got? Extending the PBS dependent visa for another 3 years OR apply for spouse visa via FLR(M)?

4) For FLR(M) I found that he needs to show money 18600£ per year and pass the English test.
a. Does this mean his income need to be 18600 or will that cover as I’m earnings are 20K +?
b. If he goes for FLR (M) does he needs to wait full 5 year from Jan 2015 to get ILR or can he count his 2 years of PBS dependent and apply earlier?

5) Regardless of what visa category my husband is applying I believe we all can go for one day service at the same day I'm applying ILR?

I would greatly appreciate you are advice to get my head around on this

Thank you very much
Regard
Sanju
