EEA2 Son over 21

Hiya,

My boyfriend was brought into the UK as a minor by his mum who is British by decent so cannot pass British nationality to him, but failed to register him as a minor. The easiest thing to be would be to naturalise him as an adult but she lied to him saying she didn't know why he had no visa blah blah for YEARS including him doing loads of applications for transfer of conditions, proof of citizenship etc, all to no avail. The truth came out that she couldn't be bothered sorting out his stuff as a child and she admit he said she brought him on the pretence of a "holiday" from South Africa and she got away with it.

Anyway, so he has been technically illegal here since he was 15 and he is 22 now, but his EEA dad (Dutch) has come over to the UK, got a job and my boyfriend now lives in a shared flat, the room being paid for by his dad.

can he apply as he doesn't live his dad (so he has privacy as an adult really) but his dad pays fro everything for him and is EU?

At first, I would like to know your own nationality and are you willing to help him to restore his status as legal citizen here in the UK?

I am British and yes I am of course willing to do anything to help him. Unfortunately settling as my partner isn't really an option as he has been technically illegal for so long!

Hi,
As you are a British, there's only one option left for you to help him, to the best of my knowledge. You can as well forget about all what has happened to him in the past as its very complicated. So I think being carer of british citizen is the option, which means you will have to continue with your relationship and once there's a child in between both of you, he can then apply with the passport of the new born baby as the father (carer of British citizen). Trust me, it works in nearly all cases and you can read more about it on UKBA website. Advantage of this kind of application is that, ukba doesn't even care how the applicant arrived into the UK, he doesn't even need to meet requirement of working in the UK before he applies. Do not hesitate to ask for more information should the need arise.

I think the EEA route sounds more likely to succeed.

If he can show genuine dependency on his dad, then he will be able to secure the right of residence.
