ILR after HSMP

ILR after HSMP

Hi everyone,

can I ask you a question on behalf of my friend:

This guy (from SA) has been on HSMP for 4 years and 9 months and has been in a stable job with one employer (a research institute) for all of this time. However, while studying, he was also enrolled on a part-time PhD course (this is a typical situation: if a PhD student is funded by a research institute itself rather than a funding body, this is often considered as employment, the salary is taxable and the PhD study is registered as part time).
Now he needs to finish writing his thesis, which is going to take two or three months and is going to consume all of his time - however, alas, his funding has run out, which means that for these months he is going to be considered unemployed.
Too bad as these are exactly the last three months before he can apply for the ILR.
Once finished, he's going to embark on a postdoctoral job somewhere in the UK.

The question is: when is the earliest (but still safe) time for him to apply for the ILR? The rules say that HSMP holders should be economically active to qualify. How would you guys interpret this statement in his case?

Did the HSMP scheme start 5 yrs ago?

It started in March 2002.
