WP- change of employment queries

Post by indblr » Fri Jun 15, 2007 1:19 am

Hi,

Could you kindly clarify some of my doubts below-?

I am an Indian national currently employed by Company-A. I am working in the UK with a work permit sponsored by company-A. Now I have got a job from company-B. Company-B has applied for a change of employment application and have got the approval from Home Office. Now my questions are as below-
• Does my current work permit from Company-A becomes invalid?
• Will this be notified to my current employer i.e, company-A?
• How long may I continue to work for company-A?
• Is it mandatory to join and work for company-B or can I still continue to work for company-A rejecting Company-B’s offer?
• In case I decide to join Company-B, may I go to India and come back before I join company-B and before I apply for FLR? My current visa is valid till 2008.
• If answer to above question is yes, may I show the current work permit visa (from Company-A) stamped on my passport to the immigration officer along with the change of employment approval from Home Office, while coming back from India to UK?

Thanks in anticipation,

I got this answer from home office for my queries ..

Dear Customer
Thankyou for your e-mail.

1) It is not invalidated until you cease to work for them.

2) Only by yourself if and when you hand in your notice.

3) While ever you continue to work with them, the work permit has not expired and you have leave to remain in line with this permission.

4) No. You can continue in line with your current permission providing you have not ceased working for A.

5) As long as you are still working for A you should be alright. If you are not, they are obliged to notify Work Permits UK and you may have problems with Immigration on your return if you have not sorted out your leave to remain before you leave.

6) see above.
