Housing Benefit Requirments

Post by imraheel » Mon May 05, 2014 2:46 pm

Hello,

I have uk indefinite visa and my two sons have british passport. My wife is my dependent and she is on spouse visa of a settled person which is FLR (M) visa.

Can I apply for the housing benefit?

Which Country is your spouse native?

Thanks Amber for your reply.

My wife is from Pakistan and has spouse flr (m) visa on her Pakistani passport. She is living in uk since Dec 2010 as my dependent.

The housing benefit would have to be in joint names but only paying a single person/lone parent applicable amount.

Why is your spouse on FLR(M) still? If she was a PBS dep before July 2012 and she switched to FLR(M) before 6 April 2014, she is eligible for settlement now on SET(M) by virtue of rule 287(a)(i)(d). B1 English and LIUK required.

Thanks Amber for your reply.

Yes my wife was PBS dependent before 8th July 2012 but the problem is that she applied and got the FLR (M) spouse visa on 26th Apr 2014. I thinks she has to stay further five years on FLR (M) visa because I had my indefinite visa last month on the basis of ten years long residence.

In this scenario: I have indefinite visa, wife has flrm (m) spouse visa and my two sons has british passport now, can I get the housing benefit?

Please reply once again.

Yes, as she switched to FLR(M) after 6 April 2014 it is indeed a 5 year route to settlement.

Housing benefit should be claimed as I indicated.
