(Urgent) From Tier 2 ICT to Tier 5

Hi,

I am from Hong Kong, thus having 2 passports, namely HK passport and British National Overseas (BNO) passport.

I am currently working in UK under tier 2 ICT visa on my HK Passport and considering to change my employer. I understand tier 2 ICT does not allow to change employer. So, I applied for my tier 5 youth mobility visa on my BNO passport and successfully got it.

So now, I have 2 passports with 2 visa.

Now I have an offer from a new employer, before I resign my current job, can anyone please kindly tell me if I can work for new employer under the below 2 options?

1) new employer sponsor a tier 2 general visa on my BNO passport
2) work for new employer with my own tier 5 visa on BNO

Or, no matter which passport I am using, I am considered as same person and not allowed to change employer? Any work around?

You can switch your employment if you can get a CoS from the new one.

If you new employer has a sponsorship license (list found here), then they can apply the CoS for you no matter it's on you HK passport or your BNO.

Just one point if you are considering settlement after 5 years of work....
Switching to Tier 5 may break the five years, and given that the total duration of leave period under Tier 2 is now six years. You may not be able to apply for settlement with 5 years of continuous stay under Tier 2. I am not sure, but the same "breaking" may happen if you switch your Tier 2 visa to another passport.
