visa time expire question

Post by ferryman » Mon May 19, 2014 10:03 am

please help.my wife lives in Philippines and has received her visa to come to uk.she has all other documentation but due to family problems has been so far unable to come to uk.Her visa expires in September 2014 which means she has 4 months to go before it expires.is there any problem with coming to the uk in this time as I have been told that like a passport there needs to be at least 6 months left on visa to be able to travel to uk.and any advice on visa extension would be appreciated as I believe if she does come to uk soon she will need to apply for a visa extension .thanks

She can enter the UK before her visa expires but will need to apply for an extension from within the UK before the expiry date on form FLR(M). If she applied for the spouse visa before 9th July 2012 and didn't take the A1 English exam she will have pass this before applying for FLR. You will also have to meet the minimum financial requirement.

Should not have to meet the Financial Requirement as it would appear that the spouse leave to enter was applied for before July 2012.

However, she must enter the UK before her current leave expires to benefit from the transitional provisions and must extend in the UK before the current leave expires (on form FLR(M)).

I sympathise with the circumstances that delayed your wife's entry, but as Amber advised you earlier this year, it was essential for your wife to enter before her spouse visa expired. Unfortunately, you are now back to the beginning and will have to apply for another spouse settlement visa. This will require you to meet the new regulations which include meeting the minimum earnings level of £18,600 per annum and your wife will have to pass the pre-entry A1 English test before applying.
