Hello,

I have got Tier 2 visa which has been sponsored by my current employer for a certain SOC code.

A new developmental job role for only internal candidates was offered in my organisation and I applied for it and have been offered this position now. A separate SOC code doesn't exist for this and it falls under my current SOC code. The job duties are similar and my key contacts and stakeholders would also be similar. Essentially even though it is a change in role, it is the same job but with more developmental opportunities. In fact, this was offered to provide development to internal staff as well.

My question is how would my employer treat this. This was only advertised internally so it doesn't satisfy the resident labour market test requirements but would my employer need to conduct Resident labour market test in this situation?

It would make sense if the job was advertised externally but if the intention is to offer development to internal staff and the job essentially remains the same, would they still need to conduct resident labour market test?

I need to make a decision on whether I accept this new role this week but I would be grateful if you could offer some clarity on this please.
