ILR Eligibility period calculation

Hi,

Could some one please guide me when i can apply MY ILR. I came to Uk on work permit and and switched to Tier1 General

06-OCT-2007 to 16-Nov-2008 Work permit
17-Nov-2008 to 31-July-2009 Tier 1 general
01-Aug-2009 to 31-Sep-2010 Worked in India
01-Oct-2010 to till today working in Uk on Tier1 general

My Current leave expiring in in 21 Aug 1015. If i calculate 5 years after i return from India i am short 40 days do i need apply another extensions ?
