Hi all,
Really impressed from this forum and have learnt loads. Not sure if I'm posting correctly, but here goes.
I hope someone can answer my query.
I am currently getting ready to apply for my wife to Join me from Kashmir on a spouse visa. I am a full time carer for my disabled parents and can only work part time. I receive a wage of 96£ per week since October 2013 and carer's allowance since July 2013, which is approximately of £60 per week. I have savings of approximately 10k. My parents own their home and do not have any mortgage. There's only 3 of us living at the property and its has 4 bedrooms. The council tax, we are mainly exempt from. So my weekly income is 156£ per week and my only regular outgoings is mobile phone bill of 10£ a month.
My understanding is that I am exempt from financial requirements, and a fall under adequate maintenance, so firstly will be able to get a spouse visa for my wife under the above circumstances ?
Secondly something I am really unclear on: In some places and guidance I have read that , I must provide 6 months bank statements and in other places I have read I must show 1 statement in the last 12 months showing payment of carers allowance. However:
In Chapter 8 section 1.7A family member
paragraph 6 evidence:
sub paragraph
(4) Where the non-employment income of the applicant or their partner, parent, parent’s partner or sponsor is relied upon all the following evidence, in relation to the form of income relied upon, must be provided:
(f) To evidence UK Maternity Allowance, Bereavement Allowance, Bereavement Payment and Widowed Parent's Allowance (or any UK welfare benefit or tax credit relied upon:: (i) Department for Work and Pensions (or HMRC) documentation confirming the person or their partner is or was in receipt of the benefit in the 12-month period prior to the date of application. (ii) personal bank statements for the 12-month period prior to the date of application
So does this paragraph apply to me ?
Is it 12 months statements ?
Is it 12 months carer's allowance ?
Kind regards
