judicial review or further represenation

Post by oaisaj » Mon Jun 09, 2014 11:47 pm

Matters: We have a child and pregnant with another and on FLR(0) application with the UKBA.

MY WIFE
arrived uk as dependant in july 2010 - nov 2011
reapply with me as student dependant and also refused with my application
we appealed the decisions together

ME
arrived uk as a student - feb 2006 - nov. 2009
switch visa to tier 1 psw - nov. 2009 - nov 2011
reapplied to switch to student but was refused as i used my brother as a sponsor to finance my stay.
appeal the case at first-tier tribunal and was declined, my solicitor instructed his barrister to write to the upper tribunal court to contest the judgement at the

upper tribunal and was granted hearing at the upper tribunal. We attended the tribunal and was again declined.

we contested the judgement again and at the same time also applied for FLR(O).

We didnt get a reply on the judgement contest as the immigration consultant (switched to immigration consultant from solicitor) sent the appeal to the wrong department

and was told to send it to the right department but the consultant didnt send it but waited until we were rejected on the FLR(0) application but we were not sent the

decision letter till date as we only heard it through the hospital manager when she wanted to know our immigration status with the home office because my wife was

pregnant with the second child.

I contacted the immigration consultant who spoke with the ukba and they confirmed their decision but havent sent the decision letter so that we can work on the

decision be it to appeal or know what to do. Anyways, he invited his barrister to advise us.

The barrister advised he would have to place a further representation on our behalf in other for the ukba to reassess our application besides the immigration

consultant is also saying we should place appeal for judicial review alongside the further representation.

Just want to know, if the above course of action on further representation and judicial review is ok or just further representation is alrite.

Thank you.
