Tier 2 general from current Tier 2 ICT

Hello,

I have worked in the UK from November 2010 until April 2014 under Tier 2 ICT visa. I have returned to India in April 2014 and my ICT visa is valid until July 2015.
I came to UK under Established staff visa in 2010 and in 2013 extended the visa for 2 more years from within UK itself after which the visa I received is called Long term visa.
I am still working for the same company in India that sponsored my Visa.
The question that I have is can I apply for Tier 2 general now (from a UK licensed sponsor) because of the below rules:

1) Cooling-off period
2) Validity of my existing (current) Tier 2 ICT visa

1) You can apply for T2(G) but the 12 month cooling off period will apply.
2) Assuming that your existing sponsor have informed home office about your early return, your cool off period will start from the day you returned from UK. Also, in this case, your existing visa is now invalid.
