Civil partnership/Student visa

Hello, thanks for your time in reading my topic. I have a problem I'm hoping you can give me advice with.

(My partner is Peruvian and I am British)

My partner and I entered in to a civil partnership at the begining of June this year, having lived together since January. My partner is in the UK on a student visa which is due to expire Sep 30th. Should we apply for an extension to stay?
When I called the immigration office, I spoke to a lady who wasnt too helpful, she said our only option is to apply for an extension to the student visa!

I'm unsure of the best course of action.

Congratulations on the Civil Partnership.

Your partner needs to use form FLR(M) to apply in the UK for a 2-year Civil Partner visa. You can download the form by clicking here.

There is no need to wait until near the end of the student visa to make the application. It should be made as soon as the form has been completed and the necessary supporting evidence gathered. But certainly ensure that the form is submitted before the existing student visa expires, otherwise a visit back to Peru would be necessary to apply for the new visa. But best to get the application in soon .... plan to do that in the month of July!

Can you enter into a civil partnership within 6 months of living togethere???

I thought it was minimum 2 yrs..

Like marriage, the Civil Partnership can be entered into with no prior co-habitation at all, let alone with 6 months of having lived together under your belt. The 2 year co-habiation rule is specifically reserved for unmarried partners only.

Yes you most certainly can! If your partner is not a UK citizen, then of course you need to apply for a certificate of aproval first. There is a time limit in which you need to arrange the Civil Partnership shown on the certificate of aproval. And also you need to have at least 3 months remaining on the visa.

Just as there is no compulsion for a couple, intending to get married, to live together prior to the marriage, neither is there any compulsion for a couple intending to register a Civil Partnership to live together, prior to the registration of the Civil Partnership.
If your partner is not a UK citizen, then of course you need to apply for a certificate of aproval first.
Not quite right! I think the following is better :-
If your partner is not an EEA citizen, and has not got ILR, or a Proposed Civil Partner visa, nor a Civil Partner visitors visa, then of course you need to apply for a certificate of approval first.

Thanks to John once again for the earlier advice!

Had a very good experience at Croydon today. Everything is so well organized, and the staff are very friendly, I didnt expect either so was pleasantly suprised! The place runs like clock work.

As expected my partners application was accepted!

If anyone has any questions about our visit, please do not hesitate to ask.

Don't people with the right of abode in the UK need to be added to the list of people who wouldn't need a certificate of approval?
