Tier2 General Changing the Employer

Hi, I am currently on a Tier 2 General Visa.

I am about to take on a another job and in the process of obtaining a new COS from my employer.
Once I received the new COS, does it mean I cannot work for my current employer at all?

I thought I can continue to work until I get my new VISA. Secondly I thought anyhow I can work up to 20 hours on my previous job if it is in the same job category.

Please advice.

Once you have the new CoS you have to apply for leave. Don't give notice until your application is approved. If it is, you can only continue working for your current sponsor until the work start date given in the new CoS.

You can only work 20 hours in supplementary employment if you are legally working for a T2 sponsor at the same time.

Many thanks for the swift reply. I only have thing to get cleared now about the following point.

If my application for the new company gets approved. That means I am legally working for a T2 Sponsor. Can I then continue to work for my previous Employer up to 20 hours as supplementary work?

Once you started working for the new sponsor you can take supplementary employment for which the rules are at para 209 in the guidance:

Hi Team,

I have series of questions related to Tier 2 General Change of Employer

Currently I am on Tier 2 General visa from the last 1 year with current employer and they are asking me to go back since my project is getting over I have new employer who is ready to transfer my Tier Visa to his company ,I have series of doubts on this can somebody help me in resolving these queries...

Q1- is that my new employer need to do Resident labour Market Test before issuing COS??

Q2- what is the normal duration for in country Tier 2 Transfer ?

Q3 - What are the documents required to Tier 2 General to Tier 2 General transfer of visa?

Q4- If I am granted with Tier 2 General with New sponcerer what will happen to my Tier 2 Lock in period for my ILR??

Q5- Are there any chances of visa rejection in this scenario??

Q6- My wife is also working with another Employer on Dependent grounds can I apply Dependent visa together ??

Q3 - What are the documents required to Tier 2 General to Tier 2 General transfer of visa?Documents required -
1) COS,
2) Two photographs.
3) Print out of Visa fee payment receipt.
4) Passport,
5) Current Bio-metric permit.


Q4- If I am granted with Tier 2 General with New sponsor what will happen to my Tier 2 Lock in period for my ILR?? You can extend your Tier 2 up to maximum 6 years. After 5 years on Tier 2 you will be eligible for ILR.

Q5- Are there any chances of visa rejection in this scenario??Yes, if the Resident labour Market Test is not conducted it will be rejected straight away. You need to fill correct form and submit correct and update documents in order to avoid rejection.

Q6- My wife is also working with another Employer on Dependent grounds can I apply Dependent visa together ??Yes, you can!
