Overtime rules for Tier 2 General migrants

Dear all,

Just needed a quick info.

If a Tier 2 General migrant is offered £ xxxxx.xx per annum on the basis of 37.5 hours per week, how much overtime hours are allowed on T2G per week including weekend with the same employer for the same job?

Is there an upper limit set out on the overtime hours for same job for which CoS was issued? Need this info as I've got an extension coming up soon & concerned if any overtime payments on the payslips will be a problem for the extension application.


PS: Pls note not referring to supplementary job with another employer at same job level that is allowed for upto additional 20 hours per week in addition to the primary employment.

Overtime is not an issue - the only issue would be if you were doing more than 48 hours per week and had not opted out of the working time regulation.

In essesnce as long as you have worked the basic hours at the stated rate on the COS you will be ok. I am assuming your payslip show basis hours / rate asd seperates the overtime? If not then it is not a great problem but I would advise you to put an explanatory note in with the payslips.

I m struggling to find a documented reference for working over 48 hours per week & opting out of working hour regulation.

Could you pls share me the link for reference?

Also for extension do we need to submit payslips or if employer is certifying maintenance on CoS, are bank statements & payslips still needed ?

You still need payslips and bank statements.
One to prove you are receiving the stated wage etc and two to prove the salary is going into the bank.as per t2 rules.

The 48 hours is outside of the HO remit but is noted.to prevent migrant abuse.
