Hello anyone that can help.

Last week i married an american lady in the UK and we want to live in Florida. We are just about to register the I130 but i am concerned about the following:

1) Do i have to stay in the UK while i wait authorisation?
2) Can i be with her in america on a tourist visa or waiver programme? If so do i have to leave every 3/6 months?
3) Can i apply for a K3 visa from there? if so do i go over there on waiver or a tourist visa?

Any help would be dearly appreciated from mr. confused here :roll:

Hi Andre,

I would advise you not to apply for the K3 visa. These days it seems to take as long as the full immigrant visa, which gives you a green card the moment you arrive in the US. It would be technically possible for you to travel to the US, but you face the possibility of being denied entry. A condition of the visa waiver program is that the traveller must not have immigration intent. I suggest you post on the following forum, where you'll probably get more advice

Marco,

Thanks so much for this... A couple of things,

1)would the process be smoother, perhaps, because i am a uk citizen and the relationship between our countries is healthy, or is this not a factor?

2) On form i130 it asks for proof of joint financial accounts and joint property owenrship. In the first instance at least this requires a social security number, yet i cannot obtain one until i am an immigrant. How do i tackle this for the purposes of the I130 form? Do i just write a cover letter, explaining this?

Unfortunately British citizens get no special treatment when it comes to US immigration. In fact they are slightly worse off, since most of them are not eligible for the green card lottery.

I couldn't find any questions about financial accounts and property ownership on form I-130 (see here). Are you sure you are looking at the right form? There is one question about your social security number, and if you don't have one you should answer "none".

You have to be very careful with this immigration issue.If they find at the point of entry that you are married to a U.S citizen but arriving on a tourist visa,you could be banned for 10 years from the U.S.
