dont know which visa or way to go

Hi,
I am a British woman and have a British born child with my Moroccan partner. We have been together for 3.5 years. Our child is 2 years and 3 months old and we've lived in Morocco and now back in the UK.

I dont have savings and lost my job 2 months ago, which only earnt me £10k per year so didn't meet the financial threshold for a spouse visa and I look after our daughter on my own and have been looking for home working work which would never meet the financial requirement.

I spoke with an Immigration lawyer firm who said there is a way to get my other half into the UK without having to go the spouse visa route but they want £2000 before they'll even tell me which way this would be so I'll never go for it as I'm not that stupid.

I want our daughter to be brought up in the UK and I want us to be a family. Is there any other way of doing this ?

I did read about the parent of a British child route, which doesn't have a big financial requirement on it, but on readng this, is seems that me and him should be separated and living separate and then they might let him in, which I find bizarre.

Does my daughter have rights to have access to her daddy on a permanent basis ?

He has a very good job in the military, but he is not permitted to be married to a foreigner, so will have to resign and leave Morocco which is sad. I think if he could keep his job and be able to marry me, then we'd all live there, but this is not possible.

Can anyone point me in the right direction please ?

You were right to be sceptical of this lawyer. I am afraid there is no easy route for you. Have you heard of the Surrinder Singh route? This might be your only option... Unless you have generous family who would give you a gift of +£60,000.

Hi, thanks for your reply....yes I've looked into the Surrinder Singh case and it was a plan to do this, but my other half is too worried about this...especially as he'll be leaving his job and I don't currently have one and is difficult to find one that enables you to work from home whilst living overseas.

i am thinking that the lawyer was going to go the parent of a uk child route and tell me to say we had split up...just a hunch...

I'm happy to try anything as we could have split up and then get back together, but i want us to live as a family and not be nervous about it..

I've been looking for work and its very difficult to find jobs that pay £19k per year even if i could put our baby into child care...all seems very unfair...

Using the Singh route, you would need to move the 'centre of your life' to another EU country. This would not be working from home; this would be working/studying for 6 months/ a year in a third country.

Unfortunately, there is no straightforward route for you, as fair/unfair as that is! I would advise you not to be dishonest or less than straightforward with the UKVI in any application. This could subject your husband to lengthy bans... Good luck!
