Work Permit/Permanent Residency Passport Renewal Question

Work Permit/Permanent Residency Passport Renewal Question

Hello,

I am currently on a WP, due to expire in September 2008. At that point I will have been in the country for more than 5 years and will want to apply for permanent residency.

My passport however is due to expire in May 2009. I have heard that permanent residency applications take 6 months plus to action and what I dont want to happen is that my passport expires before I actually get my visa.

Does anyone know if it is possible to renew my passport, ie get a new one valid for 10 years, then while my old passport is still valid, with my valid WP in it, use the new one to apply for my permanent residency on?

It seems to be like I am stuck at the moment, I need my current one with its 5 years WP in it as proof ive been here valid, but it will expire before I get a chance to get my new passport/visa.

Any advice would be much appreciated,

From where did you come to hear of such fabrications? Is your ILR application going to be aparticularly complicated one. If not, you can even get a same day service with a PEO... albeit at a slightly higher fees.

Same day service aside, that doesn't really answer my question:

Does anyone know if it is possible to renew my passport, ie get a new one valid for 10 years, then while my old passport is still valid, with my valid WP in it, use the new one to apply for my permanent residency on?

IE I dont want to put my ILR in a passport that is about to expire.

..it is quite a leap. My suggestion was for the first statement that you made. If you want a solution for the second statement, then I suggest that you contact your embassy and discuss the situation with them.

You get a new passport, and the Embassy will make the old passport invalid. You keep the old passport with the sticker so you prove you are legal. You submit both passports to the HO and instruct them to put the new sticker in the new passport

Do embassies invalidate old passports for no reason whatsoever, when they have not even expired? Which embassy are we thinking about here?

He has a reason and as long as only one passport is valid, they are glad to get the money for a new passport

Embassies do not invalidate passports. What they do is put a stamp at the back (last page) with words like, cancelled and they stamp in the new one that, the bearer of such a passport number used to travel on so and so passport which has been cancelled.

All,

Thank you for your prompt replies. I wasn't aware that I could keep and still use my old, expired/cancelled passport (whether I put an IRL in and it is about to expire, or it expires while I am undertaking the IRL process) to show the work permit status, while using my new one to come and go into the country.

Just to reiterate so that I am sure I understand.

If I wanted to, right now, I could submit a passport renewal form to my consulate (I am on an Australian passport, living and working on a WP in the UK) and they would "cancel" my old one and issue me with a new one. Now my old one would still have my Working Visa in it valid for some more time yet, so if I left the UK on holiday and wanted to return, I would need _both_ passports, my new one as this is the only one I can travel on, and my old one to establish that I have a valid WP.

_THEN_ when I want to apply for ILR, I can submit both passports, my old to show I've been in the UK continuously for the past 5 years on a WP and my new where I want them to put the ILR visa.

Is that corrrect?

When your old passport is renewed, they would staple it to the new one. If they do not just carry both. Your WP in the expired passport is valid so long as you carry both passports when entering the UK. You are under no obligation to transfer the old Permit into the new passport since the UK govt recognises this scenerio.

The only case is that, when you are due for a visa renewal or ILR, the new stamp would be in your new passport assuming the old one has expired.


NB: SYH - I was not criticizing you, just pointing the fact that passports are not invalidated (only when reported missing) but cancelled. If they are rendered invalid then, they cease to be useful or usable. Sorry mate if you saw it in the wrong context. :lol:

Okie dokie, you are also allowed to carry the approval letter as proof with your new passport except it doesnt normally say on the letter the end date of the visa.
