Hi All,

Sub: Submitted TIER 2 Application after a week of expiry of current Leave.

Am worried, I need information please.

I am working as Developer in public organisation and they Sponsoring me.

I am currently on a TIER 1 Post study work permit which is expired on 13th July 2014 and a week after on 21 july 2014 I submitted Application for a grant to Leave Under TIER 2 with a certificate Sponsorship number ‘*************’ valid from 14th July 2014.
This is happened because Lack of Knowledge and information in HR Team. She is new to VISAS application.
My Recruitment Team leader , contacted UKBA regarding my situation on 21/07/2014 and she has been advised that I can submit my Application for a grant to Leave Under TIER 2 and with covering letter explaining the current situation so that the visa can be backdated.

I submitted Priority TIER 2 application on 22/07/2014 , I received Biometric request and I gave my Biometric on last Tuesday.

Did anyone hear this type of Case before. Am really worried about the decision.It would be very grateful for your suggestion.

There is a 28 day window after the expiry of your PSW leave in which you can submit a T2G applications. However, you are not allowed to work after your visa expired and your employer is not supposed to let you. The new visa is unlikely to be backdated, the start date is normally the date of the HO decision.

What you mean by 'unlikely to be backdated' , is it gonna be any problem ??

your employer can be in serious trouble if they let you work after your visa expired - their sponsor licence may be at stake!

My VISA issued , no problem at all.
UKBA double checked with my employer and issued my VISA.
