Tier2 (General) problem..urgent help please

Tier2 (General) problem..urgent help please

Dear Gurus (iworker/manci),
This forum saved my life, i was almost doing a big mistake and reply from the forum guru's rectified that. I need more help now.

My circumstance: Im currently in Tier1(PSW) visa and trying to switch to Tier2(general). My employer has sponsorship license and they have assigned CoS for me to apply. But there are two mistakes. Wondering, sponsor note will be enough or it is advisable to request HO to allocate 1 more CoS for me. My company had only one which is already assigned for me. Now have to apply for new allocation.

mistake number1: My SOC is 2135, i am taking salary of £24k which is not enough for experienced worker to apply for 5 year leave (i know it recently, if im wrong please correct me). At CoS it is already applied for 5 years and now i want to make it 3 year due to less salary.

Mistake number2: I dont have to do RLMT and my job does not need to be in shortage occupation list as long it is available in code of practice. But in my assigned CoS. It has been TICKED on the shortage occupation list and did not mentioned anything about RLMT.

Now i have to change the visa application from 5 years to 3 years and also need to change change information about RLMT and Shortage occupation list. Can my sponsor's note in the CoS will work in this case? or better to apply for a new CoS. I have current visa now left only 25 days. Is this time is enough to have new allocation in CoS for me?

your sponsor probably made this mistake because they didn't read the SMS guidance:

Have you met the Resident labour market test? *
Tick as appropriate.
The guidance for sponsors sets out when you must
conduct a resident labour market test and how it should be
conducted. When you tick this box you are confirming all of
the requirements set out in that guidance.

If you have not conducted a resident labour market test
because there is an exemption that applies you must
still tick the box but tell us in the box that follows what
exemption applies

As long as the status of the CoS is still "assigned" (unused), both mistakes can be corrected by adding sponsor notes to the CoS, the first by changing the work end date in the CoS to 3 years (e.g. if the work start date is 1 Sept 14 the work end date should by 31 Aug 17), the second mistake as above.
