EEA4 refusal- appeal case adjourned, judge not available.

Hi all,
From my previous post, I was to go for the hearing of my EEA4 refusal appeal due to only having my comprehensive cover for 4.5 years.
Now it has been adjourned coz there's no judge to hear my case!
Where are my rights here? Does the time they are wasting for me matter? Can I approach home office to reconsider through my lawyer whom is handling all this?
They didn't even tell us when us next available date!

Could this be the HO buying time to investigate my application?
The call was from the court so I doubt the HO had anything to do with it!
