Tier 2 ICT to ILR

Hi,

I am looking for an advice on the following matter.

I entered UK via Tier 2 ICT on 15th May 2010. The CoS was assigned on 01 April 2010. I subsequently renewed this via Tier 2 ICT (Long Term Staff) and was issued a permit till 01 May 2015.

My queries are these :

1. Can I apply for an ILR before the expiry of the current permit?

2. Although I have been with the same employer so long, assuming if I were to change my employer and have a different type of Visa, will I still be applicable for an ILR in May 2015?

what was the date of your application for entry clearance in 2010?

Hi Manci - the CoS was assigned on 01 April 2010. Tbe embassy returned the passport to me with an entry date starting 27 april 2010. And I made an actual entry on 15 may 2010.

the only date that is relevant in answering your question is the date of your application. How did you apply and when did you pay the fee?

Hi Manci - I do apologise for my ignorance here. When you mean application, would you mean the company applying for the CoS or would you mean my application to the local consulate (I was in Germany) along with the CoS to have a passport stamping?

If it is the CoS payment and application, it was mid-March of 2010 ( I have requested for the exact dates).

If it was my payment at the consulate, it was April 12th 2010.

it is the date of your application to the consulate that matters. How did you exactly apply? Paper form posted, premium service appointment, online, etc?
Normally the date of payment is the date of the application for entry clearance, and in that case unfortunately you missed the deadline for ILR eligibility by one week, but the process in Germany may have been different at the time, hence the question. Also, what are the words on your 2010 visa?

Thank you very much for your reply. Obviously quite disheartened by the fact that it appears that I have missed the ILR elgibility.

To answer to your last queries :

1. I had applied personally at the embassy and paid directly when I was there.

2. The words in my 2010 visa is " Tier 2 (Intra Company Tranf) Migrant CXXXX "

My follow-up query is : In such a circumstance, is it possible that I can have renew/extend my current Tier 2 ICT Long Term visa? and if yes, for how long?

you can extend your visa as many times as you wish but will need a new CoS for each extension

I and my family personally appeared with the application form and made the payment. No, we had not sent the application form earlier on.
