Curtailment issue of Tier4

Post by dina12345 » Thu Nov 13, 2014 11:50 am

Hi
I am in need of urgent help that I am in UK since 3 years in Tier 4 , I have completed to MBA from university and got extension of visa by April-10- 2016 from college in professional course. I studied there about a year but a month before college informed me that they reported to UKVI because of low attendance and not paying fees. They also told me that you should receive 60 days letter from UKVI in next couple of days but I have not got any letter from UKVI yet. Its big confusion for me that I had updated new address to college just 2 days before they reported to UKVI. My question is that if college reported me to UKVI with my new address then UKVI will send me curtailment letter to new address or previous? or I myself inform them about my new address?
Second question is what is my status? can I switch to Tier2 before receiving 60 days letter from UKVI or I have to wait for curtailment letter from UKVI?

Please if someone help me to answer my question.

In circumstances like your, were the breach is failure to attend course without reasons, and paying fees, it is unlikely the 60 days curtailment will apply.

You can switch to Tier 2, provided it is done before the end date, before the curtailment, or 28 days after that.
