An interesting case... EEA SS Family Permit

Post by spooner » Mon Nov 17, 2014 6:18 pm

Good evening,

I have been reading these forums with great interest and I see that there are a number of people who have both experienced the application process for an EEA family permit and others who are very knowledgeable. I would be very grateful for any opinion you could express on an application me and my wife-to-be will be making in the next few weeks.

I am a UK passport holder who grew up in The Netherlands and have lived in England for around 15 years. I plan to marry my Cambodian partner (we are both over 21 years old) on the 26th November 2014 in Denmark. I am currently living and working in Germany as a freelance English teacher and have been doing so since June 2014. We met while studying for our masters degrees in England and started dating around January 2013 (she was on a 4 year post study work student visa at the time). Her visa expired in early January 2014 and unfortunately she had to return to Cambodia until September 2014, when she joined me in Germany. During this time of separation we kept in touch through email, Skype and Facebook etc. She is currently on a student visa and studying on a German course at a local college. We live together and have both of our names on the lease, which started on the First of June and is for 12 months. I recently received a job offer in England starting in January 2015 which is strongly related to my degree and is full time and salaried (over £19,000 p/a). I have accepted and this is one of the reasons we plan on applying for an EEA family permit. Our landlord has accepted our early cancellation of the lease.

However towards the end of August, I left my freelance job with a local language school (last lesson on 27th August) and a few days later I broke my finger (September 10th), rendering me unable to work until the 11th November (I have a doctors written confirmation of this). My wife-to-be arrived in Germany on the 3rd September to start her German course on the 4th September. As a result of my injury I was not able to generate any income and cover expenses until I started working again with a different language school on the 10th November. My partner is on a student visa so unable to generate income. In this period, my bank account received a transfer from my wife-to-be's parents to support our rent and food expenses (roughly 2,500 Euros). I am now working again and expect to be paid after my application is made for the EEA family permit.

I plan on moving back to England early Jan 2015, before my job starts, and live with my future wife. We plan on submitting the application immediately after marrying in Denmark.

For my time in Germany, I am able to provide invoices for teaching work, a lease, bank statements, medical invoices, and also proof of my membership and attendance at a local English social club which runs weekly. I am also able to provide a copy of my job offer, photos etc of the relationship, confirmation that we both studied together, references of our relationship from mutual friends, confirmation of the lease being cancelled early (from either agent of landlord)

My concerns relating to the EEA application are as follows;
1/ Will our marriage be viewed as a marriage of convenience, and therefore rejected?
2/ Will our application be affected by the fact that my wife-to-be was not dependent on me during my time in Germany?
