Tier 2 ICT Dependent to Tier 2 General

Post by amitfalana » Wed Dec 10, 2014 11:24 pm

My wife came to the UK in Jun'14 on Tier 2 ICT (Long Term) Dependent and has found a permanent job.
We were considering her moving to a Tier 2 General... Have following questions in the above context:
1. Is Tier 2 ICT Dependent allowed to move to a Tier 2 General visa
2. Will she have to move out of UK to apply for this change
3. Will she have to leave her current job
4. Will she be eligible for ILR? If so when... 5 years after she gets Tier 2 General OR 5 years from Jun'14 (when she came to UK)?

Cheers!

1. Yes, subject to 245HB.
2. Yes, as 245HD(b ) fails.
3. Yes, if she succeeds and it's a different employer who is supporting her Tier 2 (General) application.
4. Subject to 245HF. Previous leave as a dependant will not be counted.
