EEA4/CONFUSSION UPDATE

Post by Wise » Wed Dec 17, 2014 11:12 am

Hi Obei,Vinny and all the advisers.

Please following my post last month,i appreciate all your point raised.
Just a flash back of my issues.
1,Married 17/05/2008,got RC 24/09/2009 till 09/2014. My ex also got Worker Registration blue card in January 2009
2,1/9/2014 apply for permanent card due to divorce and i was given another 5 years RC with accompany letter saying am still a
family member.
3,Documents submitted was my ex treaty right till May 2012 and mine full 5years and i guess is because of me being unable to prove
my ex is working till i got the absolute.
4, Rang them up and they said i was given RETAINED RIGHT OF RESIDENCE IN THEIR SYSTEM.Also wrote my case worker almost
almost 3weeks now through a lawyer to state why i was issued 5 RC as family member after divorce never respond.

5, NOW PLEASE, ALL MY QUESTION NOW IS.I HAVE GOT THE TREATY RIGHT FROM 2012 TILL JUNE 2014 I.E STUDYING CERTIFICATE IN COLLEGE AND SOME ONLINE VOCATIONAL COURSES OF MY EX FROM HER THIS PAST SUNDAY.(HOW CAN I RE PRESENT MY CASE BACK TO HIM IN LIVERPOOL,OR I HAVE TO MAKE ANOTHER APPLICATION)

THAT WILL FILL THE GAP OF HER TREATY TILL THE DATE ABSOLUTE WAS ISSUED.
PLEASE ALL YOUR ADVICE WILL BE APPRECIATED
It is really good to help and everyone deserve to be respected in life. Good luck.

A Pre-Action protocol needs to be sent to them explaining that you have not been granted the documents you applied for.

If they refuse, then seek Judicial Review.

Thanks Obei, for your advice and point.
I will write again after xmas as i have just 3 month for re consideration and if he doesn't reply then i will consider judicial review.

Please my question is can i direct that letter to someone higher than him as the first one was directed to him and according to the link you gave me.Reconsideration letter will be dealt with by different caseworker of the same team staff.

Any way way of getting senior person will be appreciated.

thanks.
