family residence permit NL problems

Hi there,

I am Moroccan married to German who is living as a student in the NL.

We married in november in Turkey with her Turkish citizenship, she started the registration process of the marriage with the international certificate on first of december, the townhall told her it cant take up to 10 weeks until it is in the system.

I applied for a short time visa of 28 days which will expire on 17/01/2015, we went to townhall for my registration in order to get my residence permit. There they told us that they dont believe that my wife is living here even if she is already registered in same town hall.

We got the information that they will check 3 times if she is living here (NL) and this can take 3 months and even more time until everything in their system is done.

So i want to know if this process accors to the EU laws and which opportunities i have to stay legally here and to get a proper visa for this.

Hi there,

I wanted to share the news.
To be sure that I will be legaly here for more than 28 days I got a new visa, so I can stay here now in total for 90 days.
The government checked now two times our home, so one time left.
From the government I got a paper called bewijs van bekendmaking bij de gba. With this we have to go to IND to apply for the residence permit. My wife got a letter which says that the marriage registration is still in process and it can take 8 more weeks.
When we called IND to make an appointment for the residence permit, IND said we need sufficient meanings of minimum 1385 € per month or savings of 12*1385€.
We went to a lawyer to check this information, she said IND cant ask for a minimum amount of money, cause they need to see our circumstances and situation. Also she said actually it should be enough when we have the half amount of one minimum monthly salary per month for both of us.
On the IND website https://ind.nl/en/individuals/family/co ... quirements they give different amounts.
I am looking forward that anybody knows better about this procedure and how much sufficial meanings we really need for my residence permit.
