EEA4 Application without Sickness Insurance- other routes?

Post by sarapk » Sun Jan 04, 2015 9:12 pm

Hello,

I am currently on a spousal visa, I am Canadian and my partner is an EEA national who has resided in the UK for over 7 years. I have resided in the UK for 6 years and we have been living together for 6 years. My current spousal visa is due to expire soon and I have been directed by the UK Border Control website to apply for permanent residency through the EEA4 form. My husband was a student for most of the time but had no sickness insurance, which they require proof of. Therefore we are unlikely to pass the application.

As we cannot prove my husband exercised treaty rights without the CSI proof, are there any other routes for me to stay in the UK?

Thank you in advance for your help,
Sara

If your husband is an EEA national exercising treaty rights in the UK at the moment, you can always apply for another EEA2 (residence card) which will prove your right to be in the UK. What is your husband's citizenship?

Which visa did you have before? Was it a spouse visa issued under the UK immigration rules? Or something else, perhaps a residence card issued under the EEA regulations? Your post isn't clear. Clearning this up will help people to advise you on what you can do going forward.
