Help - Wife spouse visa and sponsoring brother

Post by desi_lad » Mon Jan 05, 2015 5:59 pm

Hi all,

I'm a British citizen and am married to a pakistani wife. She is living with me in the UK on a spouse visa under the new rules. I want to sponsor my brother who was born in pakistan and still resides there. (my brother wants to visit the UK). I am planning to use the family visit visa to sponsor him.

Could someone please answer the following for me:

As i am sponsoring my wife, is there any problem me sponsoring mt brother on a family visit visa at the same time - for my wife i sponsored her through my income from my job?

I have plenty of saving's in my bank account and i own the house i live in - will that be suffice to show that i can support her

What document would i need to show, and what would be required of my brother apart from identity information etc.

I know that people have had their family visit visa's rejected because the ECO could not be satisfied that the person would not leave the UK, but this wont be a problem for my brother and will be easy to prove as he has his own family there including children etc.

Thanks all.

I suggest you start by doing some research on the financial requirements for a spouse visa.

https://www.gov.uk/join-family-in-uk/eligibility

There are stringent requirements for evidence required.

He's not asking for information on a spouse visa lol. His wife is already in the UK on a spouse visa.

He is asking can he sponsor his brother from Pakistan to the UK and would the fact his wife being on a visa in the UK affect the application.

To answer the question although someone with more experience will come along and answer it I would say it would not affect the application however I may be wrong.
June 30th 2014 - Applied for spouse visa (Pakistan)
August 11th 2014 - daughters Right of Abode applied
August 18th 2014 - Right of Abode successful
December 2nd 2014 - Spouse visa refused
December 29th 2014 - Reapplied for Spouse visa

Of course, you can sponsor your brother to visit or anyone, provided he can show beyond reasonable doubt he will leave UK as stated. The onus lies on him to prove that though, not you.
Having family and children won't be enough to prove he's going to leave,he's got to prove:
Being gainfully employed and income good enough to return to.
Having property or business or stable genuine source of income.
Evidence of the sources of income.
Just stuffs to prove he's just coming on a visit,if he's relying on your savings or what YOU have got in your account, I'll suggest you forget it.

Sorry! I completely misread that! I thought he was asking something completely different - actually, I have no idea what I thought he was asking!

The two visas have nothing to do with each other! Your brothers application will be decided on its own merits, surely.
