Visitor in Transit Visa Required or will TWOW be issued?

Post by scrudu » Thu Aug 09, 2007 4:03 pm

Hi there,

Can someone please advise me on the following situation?

My husband is Indonesian (=UK Visa Required) living with me in Ireland (me Irish) on a D-Spouse Stamp 4 Residence Visa (perm residence). He has a valid multiple entry Schengen Visa already. We wish to travel together to Greece next month, and will be transiting through a UK airport (Manchester or Bristol most likely). The flights will not be bought together, i.e. Leg 1 Dub-Man will be booked directly with Ryanair, and Leg 2 Man-Greece with ThomsonFly. So we will need check in for Leg 2 in the UK Airport. The 2nd flight will leave just a few hours after the 1st arrives.

I know when he last passed through LHR airport with an onward flight (all booked through one airline, and had his onward boarding cards as well as his bags checked through to DUB), they gave him a stamp valid for 24 hour marked "Transit" which allowed him to pass through on to his 2nd flight onwards to Dublin.

When I input the info into http://www.ukvisas.gov.uk/ it said
You asked if a national of Indonesia needs a visa to come to the UK in transit.

At the discretion of a UK Immigration Officer, you may transit without visa (TWOV), but only if:

* you will continue your onward journey from the United Kingdom by air within 24 hours, and
* you will hold a confirmed onward ticket, and
* you will have the necessary documents (passport, visa, etc. ) for the country to which you are travelling and any countries that you will pass through en route, or
* you will arrive on a cruise ship and intend to depart on the same ship within 24 hours.

If not, you need a Visitor in Transit or Visit visa.
Q1) As our flights will not be connecting (i.e. not all booked through one carrier, although we will be flying out a few hours later) does this make a difference to whether he will be deemed eligible for TWOW (Transit without Visa)?

Q2) Will my husband have hassle checking on to the flight to the UK with DUB Airline staff (and on return flight with Greek airline staff) who will only see the ticket in their system, i.e. flight to the UK. Do you think if we show them our onward tickets, and that we intend to fly onwards, that they'll accept that we are only transiting, not visiting?

Thanks!!

I don't think you will have any problem DUB-UK (or UK-DUB) because everytime I have flown nobody has checked my passport. However you might have problem ATH-UK as airline might refuse to issue boarding pass to you. They might not let him travel as they will get fined for letting your husband travel without visa if they are caught by UK authorities.
I suggest you check with the airline and print out the UK Visa page and take it with you to avoid hassle, and show them all your tickets.

And - probably stating the obvious - check in early!
