PBS Dependent Eligibility ILR ?

Post by kumsan1409 » Thu Jan 08, 2015 6:10 pm

Guys ,

Need urgent help to know whether my spouse is eligible for ILR or not, following are clearance details ..

From 18-Oct-2007 till 12 June 2009 ( IN UK)
From 17 March-2010 till 08 July 2012 ( IN UK)
for some family reason they had to leave UK 8th with valid leave which was valid till 26/02/2013 for some family reason . I had a plan to bring them back as soon as possible but did not work their visa expired on 26.02.2013. I was waiting for my extension here after getting my extension i applied for them within 16 days on 14.03.2013 and they got the clearance and came here on 17 May 2013 and staying here with me..

I spoke to home office about this whether this will considered as continuous period or broken they said it will be considered as continuity toward ILR so now I am little bit confused whether they will qualify 2- year or 5 year route for ILR.

and the reason for asking this is that if they quality 2- years route i will not worry about the absence they had from July till March..

Ant thought whether they will qualify 2- year or 5 years route ?

If they qualify 5 -years route will 180 days absence will apply for them as well as they are dependent ..

Any response will be highly appreciated .

Thanks Sandeep
