ILR instead of Tier 1 dependent extension

Post by guyinlondon » Thu Jan 29, 2015 10:37 am

Dear Experts,

I am asking this question on behalf of my friend.

My friend was on Tier 1 General Visa when his wife came to UK as his dependent. His wife came to UK on 05th May 2013.

On 07th January 2015 my friend became British citizen and his wife visa will expire on 08th October 2016.

My question is can my friends wife apply for ILR directly instead of applying for Tier 1 dependent visa extension because by October 2016 she would have completed 3.5 years in UK on the basis of my friend being British Citizen.

Please help us gurus. We have heard that British citizen spouse can apply for ILR after three years of marriage.

Thanks,
