Less than 5 years, more than 450 days, but husband...

Hi Guys,

I tried to find any info about my situation but no luck so far :(, so would be grateful if someone can answer on following questions.

Thanks in advance!

I've been a holder of Tier 2 visa since 1.12.2013. My wife has been in procession of a Tier 2 spouse visa since 1.6.2014 but at the moment she is not living in the UK (opposite to me of course ) as she is still a student. Every month we spend at least a week together either I go to my home country or she comes to me.

i'll renew (fingers crossed) my visa on 1.12.2016 for 2 more years and she will do that too.

My question is after 5 years I'll be able to apply for ILR, my wife will have Tier 2 visa for 4,5 years with roughly 800 days outside of the UK (she will move here by the end of this year, early next year) what will be her status once her visa expires?. She can't apply for ILR because of less than 5 years and more than 450 years outside of the UK.

Is there any visa which she will be able to hold until I become an UK citizen and she accomplishes 3 years of living in the UK in order to apply for the UK passport.

On separate note just to confirm for a spouse requirements for UK citizenship are
- married to a British citizen
- 3 years in the UK with maximum 270 days outside

This is based on https://www.gov.uk/government/uploads/s ... c_2014.pdf. I came across also that all holders of a Working Visa after 2013, spouse needs to be in the UK for 5 years.

Last question, as my wife is a doctor there is a restriction on her visa that she can't work as a doctor in trainee. Once I become ILR will she have the same restriction as a holder of a new visa?

THANK YOU
