TIER 2 and SOC Code change

Post by IA_FAITH » Mon Feb 23, 2015 10:19 am

Hi Everyone,

I have a valid UK Tier 2 valid until December 2016. I have been working for 2 and half years for the same company and I am changing role within the company. It involves a change of SOC code (from 2139: IT Consultant to 3538: Financial Accounts Manager) and a salary increase of £2K.
Does my company has to apply for a new TIER 2 visa for me? Or reporting the change on the Sponsor Management
System (SMS) will suffice?

Thanks
Shauna

My company was exempted of the RLMT as per the guidance for sponsors P85:(https://www.gov.uk/government/uploads/s ... _11-14.pdf)

28.5 If the migrant is already working for you and they need to extend their leave to
continue working for you in the same occupation, you do not need to conduct a resident
labour market test.

I am not sure if they have to do it this time.

Manci, are you able to provide your input.

Thanks
