Post by olamilekan101 » Sun Aug 19, 2007 8:11 pm

I have been living Illegally in Ireland for the past 5 months as i entered the country via UK who gave me a visitor visa. Some months ago i got married to my wife who happens to be an Eu national (Lithuanian) and resides legally in Ireland. We have been living happily before marriage and even after. The problem i am having is i cannot work legally and i am a Graduate Structural Engineer from Nigeria. While in the UK i joined the membership of Institution Of Engineers Ireland as an Assocaite member. Please can someone advice me of how i can go about my imigration status so i can become legal in Ireland.

You will need to apply for a residence card with the EU-1 form. However... unless you have resided legally together in another EU-member state previously your application will most likely be denied (and this can take up to 9 months). While your application is in progress you can reside legally in the state, but you are not allowed to work.
Please read many of the other threads in this forum about EU1 form and EU-nationals married to non EU nationals.

Having lived (and worked?) illegally in Ireland doesn't do your case very good...

Not a chance....

You will have to contact the DOJ as you where not legal when you married. Your profession will stand for nothing in the eyes of the law

your marraige to a lithuanian will be scrutinised also

the only thing you can do is plead your case to the DOJ

Can you and your wife move to the UK? You can apply for residency in Ireland or from Nigeria, and return to the UK under the EU directive. You won't be able to stay in Ireland based on their fuzzy interpretation of the EU directive on free movement, so your best bet is to move abroad.

You will have to leave Ireland. Though you are married, you can seek another route. If you are able to leave Ireland without getting caught being there illegally, you can look into finding a job first. You can apply for a visitor visa for Ireland and search for jobs, though you will have to leave again while waiting for the permit. As a structural engineer, you should qualify for a green card, so there shouldn't be any issues. Look into that. Engineers qualify for green card through the high skilled shortage areas.

Good luck, Cheers!
