Seeking Tier 2 - To join spouse on a Tier 4

Post by Shaalt » Tue Mar 03, 2015 7:15 pm

I am going to try and keep this as short as I can. My wife has been accepted into the University of Edinburgh and will not have any issues securing a Visa for herself. I am encouraging her to go but she doesn't want to be away from her family (myself and our 2 sons) for 4 years while she completes her education.

I have been reaching out to company both in my current field as well as companies on the Tier 2 sponsor list provided by immigration and have yet to receive any offers and little correspondence. I think this is due to my lack of a formal education.

My questions is if it possible to be able to secure a visa without a formal education. I am also up for any advise as well.

Thanks you all for you time.

if your wife will be on a T4 visa it is likely that you and the children can come to the UK as her family members. If you do come there will be no restriction on the jobs you can take. Read the PBS dependant policy guidance

I have looked into this but I do not think my wives program is considered post graduate. She received an unconditional offer into Edinburgh's International Relations & Law starting at year 1.

She can't apply until June but from everything I have read she will be getting a Tier 4 (General) Visa.

Unless I am misunderstanding the system my wife is not in a post graduate level:

From PBS Document:

Applying as the Family Member of a Tier 4 (General) Migrant in the UK
32. If you are the family member of a Tier 4 (General) applicant, whether or not you can apply for the PBS Dependant category in the UK depends on the type of permission to stay that you have and type of course the Tier 4 (General) student is studying, or will be studying.
33. You can be the family member of a Tier 4 (General) applicant where they are applying for, or have been granted, entry clearance, leave to enter, or leave to remain in the United Kingdom as a Tier 4 (General) Student if:
(i) the Tier 4 (General) applicant is a government sponsored student who is applying for, or who has been granted, entry clearance or leave to remain to undertake a course of study longer than six months; or
(ii) the Tier 4 (General) applicant is:
a) applying for, or has been granted entry clearance or leave to remain in order to undertake a course of study at post-graduate level for 12 months or longer;

you are right, I overlooked that your wife's course was not at post-graduate (NQF7) level - so unfortunately you cannot come to the UK as her family member

Manci I want to thank you for all of your input.

I have spoken with an immigration professional in Edinburgh and pretty much confirmed Tier 2 is my only option. Do you know if Tier 2 Visa's are easy to come by if you are not college educated?

To come to the UK under Tier 2 you would need to be sponsored for a NQF level 6 job. The list of jobs is here:
