Work in NI but want to live in Ireland to bring non eu wife

Post by marwat » Fri Apr 17, 2015 8:13 pm

Hi
I am a British Citizen who has never visited or lived in Northern Ireland or Ireland.
I will get a job in Northern Ireland as a locum Doctor for 3 months in Craigavon, which is 30 miles from Republic of Ireland. The closest towns are Dundalk and Monaghan. I want to bring my non eu wife to either of these two towns and rent a flat. I will travel to Northern Ireland daily to work and come back to republic of Ireland.

In this situation what is the best way of bringing my wife to Republic of Ireland for at least 2 months. What category will I apply for my wife. I tried looking at the visa application online and the most likely category she comes in, is short visit Category C, family member (spouse) of EU citizen.

But at the moment I do not have accommodation in Ireland and in that section what will i include.

Please give some advice

In your situation you do not have to have accommodation already in Ireland for your wife to apply for the C visa as the spouse of an EU citizen. All you need for the application are both your passports, marriage certificate and a declaration that you will be travelling to Ireland, and that is all. Here is more info about it from INIS.

However, if you plan to stay in Ireland longer than 3 months, INIS requires that your wife must apply for a residence card through form EU1 plus in your situation you would both be expected to get comprehensive sickness insurance after 3 months in Ireland.

I understand the rules for this but how do i go about it practically. Because when you go online to apply for the visa it doesnt have a section where you can write these things. It asks for an address of a person in Ireland so should i leave that blank. And submit the application form with intended dates of travel. So after that when they ask for appointment for biometrics of my spouse in Pakistan then do you have to print out the rules and will they ask for payment? Im just wondering what are the steps of how to apply in this category. What website and what things should i include. Thanks

You should write that you are travelling separately in the parts where it asks if you are travelling together and where it asks for an address. If you wish, you could reserve a refundable hotel through booking.com to show your intentions to travel, and write that hotel address in the address part. This is what I know some applicants did for their entry visas to the Schengen.

You can cancel bookings on some hotels with booking.com and get a refund, by the way. It's not in any way compulsory to do that - I'm just saying that this is what some family members do for Schengen visas because some EU embassies illegally insist on production of flight tickets or hotel bookings even if the family are travelling together. Presumably you will need a hotel when you get to Ireland so why don't you book some days there for yourself in advance and say that your wife is joining you there as presumably she is going to need somewhere to stay until you find a place. It's not necessary to show 2 months of booking unless the embassy is being highly unreasonable, because it is "free movement" after all, as what if you changed your mind and wanted to go to another part of Ireland. If it were me, I would only apply with the documents that the INIS website asks for and no more, which would include only a declaration that you and your wife will be travelling to Ireland, albeit separately. I would not even bother with hotel bookings, personally.

Thanks for the information.
I have filled out the application form and my wife will be submitting her documents on the 30th of May in Islamabad. Hopefully it gets accepted.

marwat, as per the plan you have summarised I notice you live(ed) in Eire but work(ed) in Northern Ireland.

I'm interested to know how this has worked out.
Are you intending to use the Surinder Singh route?

If so, very interested to know (when you apply for a UK Family Permit or RC) whether Home Office will accept you had moved your centre of life to another EU country.

This is because in the ECJ case of O & B (C-456/12), merely being a recipient of services in another member state does not entitle the right of residence in the country of origin.
The ECJ held that third country national family members of EEA nationals can derive a right to residence, but only if there is compliance with articles 7 and 16 of the Directive by their EEA nationals in the host state and the creation or strengthening of family ties with the non-EEA national in that host state.

Hence, without genuine and efficient exercise of Treaty rights in the other EEA member state by the EEA national, there cannot be a derivative right of residence for family member in the sponsor's country of origin.
Do you have any updates or insights you could share?
Many thanks.

The principles established in OB, are far removed from the provision in place for frontier workers, who are covered by eu law, both in their place of work and place of residence.
