Hi, I have an offer and planning to switch employers, the employer is happy to help me with tier 2 visa, on which i have spent nearly 4 year 6months, but as I become eligible for ILR in 2 months too, my new employer cannot support me with ILR application too, as I would have been employed by them once I join them for less than a month.

As per Set(O), i understand, I would need to provide details of salary and bank statement and pay slip of last month, but as I would have been employed for less than a month, I will not have any salary from my new employer in account- what would be the best way, to over come this barrier? secondly, for holidays, as over last 4.5 yrs or so all holidays were generally paid but record with old employer, would I need to ask my old employer to provide me letter saying holidays were approved and as per company policy? would there be any other considerations, I should be wary off and any other complexities I should take into account? also, any specific documentation ill need from my old employer?

your help would be much appreciated. thanks

the emloyer doesnt really need to sponsor u for ilr. all he needs to do is give a letter stating that u are needed in foreseeable future and are paid at or over the relevent soc code.
you do not have to apply at exatly 5 years. if you would not have had a pay slip, u can delay the ilr application by a month and then apply.

U can ask for a letter from current emploer about the holidays you have had in last 5 years and that they were part of annual leave/paid leaves.

As iworker already replied you can switch employers and apply for ILR few days later. But personally I will suggest that you apply for ILR and then go for employer switch. There are two points in favor of this:

1. No hassle for ILR. You ll get everything from your current employer. Just make sure that you will get the letter from current employer that you are needed for the job.
2. After getting ILR you can look for job with any company as there no tier 2 visa will be needed so you may find better opportunities.

Why are you complicating your circumstances by considering changing employers at such a crucial time?

Without ILR, you have to successfully apply for further leave to remain (245HD) before you may work for new employers.
