I am currently on TIER 2(General) visa in UK from Jan 2012. I had 3points on my licence in april 2012 which has now expired and would be removed next year. I just got a letter from DVLA informing me that the Leicester and Rutland court has prosecuted and convicted me with MS90( failing to identify driver) on 12th May 2015. I am getting 6 points and around 745 GBP fine.
I have applied for a statutory declaration as I never received any NIP or court summons and I was prosecuted in my absence or knowledge. As per expert legal advice and other source, I might be still found guilty( even though I am trying to fight back as I ensured that all the details on my documents are correct but unfortunately the incident happened on 2nd september 2014 and I sold my car on 8th September 2014, got a new car with current address on V5C document, the driving license had correct address from 17th AUgust 2014. I changed my job and moved to a new city in first week of August and all this happened in that transition period)
With 6 points for MS90 what are my chances at getting ILR ?
I would be eligible after Jan 2017 and want to apply ASAP after the due date.
Have I screwed my chances all together ?
Can taking it to the court and defending it affect the application if I am still found guilty ?
Can asking the court and resurrecting the original driving offence and taking 3 points improve my chances in any way ???
Please help !
