Hello all,

Pls pls help me with this query.

I am currently on a Tier 2 visa general with an umbrella company compaNy. I am on this category for one year From may 2014.

At the moment I have got another employer ready to sponsor me. The problem is they are only ready to offer me the new entrant pay not the experienced worker and they think that I come under experienced category because I have already on tier 2 general.

For your information. The Soc codes going to be different and the salary is Gona be same.

Also I am under 26 turning 26 in November 2015. Will I be new entrant or experienced. How can I make the employer understand. I have showed them the tier 2 guidelines where it says in page no 3.

Also do they have to do rlmt. They are MNC they a have advertised this position in their website and linkedin too. Also I have had three rounds of interview and got selected out of five people (including british) someone please help me. Your every single suggestion help me And it here too.

when does your visa expire, or has it expired already? Note that umbrella companies are illegal and their licences are being revoked all the time as UKVI finds out about them

the rules on p3 of Appendix J are quite clear:

if HR don't understand they should ask a solicitor. Note that with the new entrant rate your total stay on T2G is limited to 3 years

RLMT is needed and it has to be done according to UKVI rules, advertising on Jobcentre Plus is mandatory:

My visa expires in may 2017.

I have been in tier 2 for only one year.

In the guidance of tier 2 or 5 sponsor. Multinational companies can advertise in their own website. Also some agencies not necessarily hob centre plus . Can you help me to clarify this please.

Once again thanks for your reply.

This is what I was discussing about. For your information the position they offering is "Microbiologist-2112" which is Occupation skilled to PhD level.

Si I beleive it falls under the exception in advertising job centre plus

Also in as it says in section 28.41, They can advertise in their own website since they are MNC?

28.19 All jobs must be advertised online to settled workers through the Jobcentre Plus
Universal Jobmatch service (or for jobs based in Northern Ireland, JobCentre Online). The
only exceptions to this rule are for:

a) Creative sector jobs where the code of practice says that advertising is not needed
because the migrant will be making an extra contribution to the UK labour market (see
the creative sector codes of practice for more information). They can be found on our
pages on the GOV.UK website at: http://www.gov.uk/government/collection ... oyers-and-
educators#codes-of-practice.
b) Milkround recruitment exercises.
c) Pupillage positions for trainee barristers.
d)Jobs which fall within the PhD level SOC codes. For more information, please see
criteria.

28.41 If you are a multi-national/global operation, or have over 250 employees in the UK,
you can advertise the job on your own website.
