Post by gur88 » Thu Jul 09, 2015 12:11 pm

hello guys.
i need your help.my story is like this.
i am an indian citizen married to an italian citizen and we came in uk 1april.silly me got a tourist visa instead of eea fm.so i was unable to work.my wife was 5 month pregnant that time.now its been three month and we are still in the same position. hell ofcourse.in these 3 months we rented a house for our accomodation proof in order to apply for my reident card.now my solictor told me that u can apply for resident card and your wife too for registration cartificate even though she is not working.she told us that saint prix lae apllies on both of you.ok then we sent our applications to home office for resident card for me and registration certificate for my wife.we paid home office fees through my wife's account..but till now home office deducted fees for one of us and we did nt received acknowledgement letter yet.
i need to work to support my family and our baby is coming just after weeks.
any advice from you will burn my stress...
thanks

Well, your bad, that you came on a tourist visa.

Now, the straight answer is, your are stuck.

I read Saint Prix Lae judgement. Your solicitor is wrong. This judgement does not cover you even remotely. The judgement only helps, if someone has a status of worker already, and then they have to stop work, in the "late" stages and "aftermath" of childbirth.

The judgement does not at all cover people who never had the worker status to begin with.
