Hi Experts,

I am quite new to this forum but find it very helpful for immigration queries. I have the following query hope this will be answered in this forum -

My Query (Restricted CoS) -

Points awarded for salary on restricted CoS is based on pro-rata basis or on gross salary + guaranteed bonus?

Let's assume the salary is £27,500 for 37.5 hours per week. So the points will be awarded for £27,500 (9 points) or prorate basis i.e., 39/37.5 * £27,500 = £28,600 (10 points).

I would be grateful if you please answer to my above query. I look forward to hearing form you

Hi mtz009,

The salary you put on your CoS should be more than or equal to the salary mentioned against on the Codes of Practice for Skilled workers (https://www.gov.uk/government/uploads/s ... 4_V0_6.pdf) pro rated to 37.5 hours.

Example,
Your job code is 2142
1) Refer page 4 of the PDF - Salary mentioned is for a 39-hour working week.
2) Open page 50 - salary for new entrants is £20,500 / Experienced: £24,600

Now the new entrant threshold value for salary applies to you only when you are,
a) Graduates switching into Tier 2 (General) under the post-study provisions;
b) Graduate recruits where you have used a university “milkround” to satisfy the Resident Labour Market Test;
c) Graduates sponsored in the Intra-Company Transfer Graduate Trainee route; and
d) Any workers making an initial application who are aged 25 or under on the date they apply.

Presuming you are an experienced applicant, if you are working week has 37.5 hours then the salary on CoS should be more than £23,654. And if its 39 hour week - the salary mentioned should be more than £24,600.

The points are not prorated. If you meet the above requirement only then you are awarded the 10 points.

Salary on RCoS is not prorata basis. When UKVI awards points, they do not consider number of hours in a week but what they consider is that only the base salary which includes all guaranteed bonueses (The salary must be within the range what was advertised).
