Appeal Decision

Post by RAJ2007 » Wed Sep 26, 2007 4:11 pm

My friend had his student visa appeal hearing two weeks before. But still hehas not received the decision. he enquired ATT helpdesk and they told that the decision is still reserved, that means the judge has not informed any decison.

How long the judge take to make a decision? Is there anything else he should do? How long he should wait?

Nothin he can do. I think the judge has 20 days to get the decision out, so it should be soon.

Thanks for the reply.

Is it 20 working days or just 20 days?

He needs to wait a little longer.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.

It depends on the particular judge and on how busy they are.
In most circumstances, it takes about a month of waiting but I have heard cases when the appellants were waiting 3 months.

Tribunals are usually quite good in delivering determinations quickly. They have recently been completely restructured and reorganised by DCA.
It is the Home Office that delays implementing decisions specifically in cases where an appeal has been allowed and when there is no basis for further challenge. In such a case he will have to chase the appropriate grant through the acting POU.

My friend is still waiting for the determination. It's now 5 weeks. Is there really no deadline for the judge to deliver determination?
