Can I make a Tier 2 application IF ILR refused

HI,

I am on eligible for ILR in sept '2015. I want to know if my ILR gets refused(by chance) can i make an Incountry application for tier 2 general as my company wants to sponsor me as they are ready to apply for sponsorship certificate . Are there any other options left for me as my visa expires on oct 30th.

If your settlement is refused, and that decision is taken after 30-Oct., you will be given the right of administrative review that will need to be applied for within 14 calendar days of receipt of such refusal.

If you do not wish to apply for administrative review then you may make an in-time application for leave to remain within those 14 calendar days. If you make an application after those 14 days have lapsed, it will be considered as an out-of-time application and if refused will not have the right of administrative review.

Do note, you'll become an overstayer after the said 14 days lapse if you do not either apply for administrative review or make an application for leave to remain.
