Perhaps someone could give me some advice as I have been trying to get a sponsorship certificate for the past 2 months to no success.
I was on a tier yms for 2 years which ended on august 1st. I then went back home to apply for a tier 2 sponsorship as my employer wanted to continue to sponsor me. I am a teacher of science- I have taught across all 3 science subjects in my school in the past 2 years and am officially qualified in chemistry, math and biology in my home country.
The first time I submitted an application, I received an email that my employer had acquired an unrestricted COS which was not applicable and I was told that they needed to acquire a restricted COS so I withdrew my application.
They then applied in september but were denied a restricted COS based on too low points- only 34 points based on RLMT. They had done an RLMT and they had stated it was shortage but home office only gave me 34 points. I am not sure if it is how they worded their application or not.
My employer is now saying to try again they would have to redo RLMT which will take a month.
I am arguing with them that I teach science primarily and significantly chemistry and physics and should be considered a shortage occupation and thus exempt with RLMT.
My employer is saying that if they do not redo RLMT then it looks like the job is no longer needed or has been acquired which it has not. Actually the school I teach at is short 2 teachers in science department right now and about 5 others across the whole school.
Am I wrong to feel that if it is on shortage then it should be exempt from RLMT,
Do I have any hope at all in this or do I just need to give it up.
