Hi Manci,

I am currently sponsored by my employer under TIER 2 General. Please Find my VISA details below.

Current Visa: TIER 2 General
Visa start Date: 12/11/2012
Visa Expiry Date: 12/11/2015
SOC CODE at my initial VISA grant under soc 2000: 2132 ("Software professionals" is in Shortage Occupation List)

My Query:
I am planning to extend my VISA with same employer and same occupation this November. But my salary is 26,425 (Including Bonus and Pro rated to 39Hrs)
According to new soc 2010 codes my employer says I fall under the code 2136 which makes my pay ineligible for extension as 2136 is at NQF Level 6 and requires 31,100

Can I extend my visa a lower NQF Level? Like NQF Level 4 as my initial job code 2132 was on "Shortage Occupation List".

If yes, Does my employer need to do RLMT again for the job code under NQF Level 4 for extension?

Please help me on this.

I think since the original soc code 2132 was not nvq level 4, (although it was shortage occupation but not nvq level 4), you can not move to level 4 job.
you will also have to change the new soc code to 1 of the 3 soc available , whichever implies to u more closely and get paid according to new code relevant salary
