A CALL FOR HELP!! DLR EXTENSION IN A BIT

Post by Florah » Thu Oct 15, 2015 3:16 pm

Hello everyone,

I am new to this forum, I've only just joined though I have been reading a lot of immigration posts on here and I am inspired by the way members profer possible solutions and encourage oneanother. To the administrators, thanks for accepting me, I hope to be of immense help to fellow members.

I need your help please as my visa is due for renewal and I really don't know what steps to take. Here's my situation briefly,
I came into the UK as a student in Sept 2008. I was granted post-study work visa in January 2010 till January 2012. My husband and I got married in December 2010 and we were both both on post-study visa. My husband then applied for the Tier 1 general visa just before it was discontinued. After appeals and and all, he was granted Tier1 general visa for 2years in September 2011. It was only sometime in November 2011 that we realised I am required to travel back home to apply as a dependant, however, at this time I was heavily pregnant and had some complications which the doctors were monitoring. My solicitor at the time advised I would need to apply outside the immigration rules and suggested I get a letter from my doctor to support my application. I was lucky as I got a letter from the doctor which strongly recommended that I do not travel for now. Guys, this was my saving grace! My application was initially refused, but after an appeal, I was granted 2.5 years from September 2013 till December 2015. Now I need to send in my application 28 days before my visa expires, I don't know what to do. I have spent a lot on visa application, lawyer fees, to be honest I cannot afford it anymore.

My husband on the other hand, has been battling with his Tier 1 general renewal as he was refused based on accountant's error (accountant used wrong format for his self employment business calculations). We've appealed but was dismissed. We've gone to upper tribunal who say his appeal should be looked into and not just dismissed. Now we've been given a date in November.

My question is, how do I renew/extend my DLR? I am thinking should I try and get a letter from the doctor regarding my son as he was recently assessed by a speech therapist who thinks he's doing fine but needs help in some areas and needs to be seen again in a few months. If the HO sends me home or refuse my application, I will have to go with my son's (I have 2 sons born here) and this will affect him. Do I have a case at all??? Please help me
